BACKGROUND
This Privacy Policy explains how Wearable Devices Ltd. (“Company”, “we” or “us”), through Kavana, its physical-AI unit, collects, uses and protects personally identifiable information (“PII”) in connection with the kavana.tech website, our communications with you, and the pilot and data programs we run with partners (together, the “Services”).
By using the Services or providing PII to us, you consent to the processing of your PII as described in this policy. If you do not agree to this policy, please do not use the Services.
If you have any questions about this policy, please contact us at support@kavana.tech.
1. INFORMATION WE COLLECT AND HOW WE USE IT
1.1. Information You Provide.
When you contact us through the form on our website, we ask for your name, the company or lab you work for and your email address. You may also tell us what you are building, describe your current sensor stack and choose what you would like to start with. We use this information to respond to your inquiry, scope a potential program and follow up with you.
1.2. Communications.
When you email or otherwise communicate with us, we may keep those communications in order to process your inquiry, respond to your requests and improve our Services. With your consent, we may also send you news and updates about Kavana. You can opt out at any time by using the link included in the message or by emailing support@kavana.tech.
1.3. Technical Information.
When you visit our website, we may automatically receive technical information such as your IP address, browser type, device type, approximate location derived from your IP address and the pages you visit. We use this information to operate, secure and improve the website.
1.4. Analytics.
We use analytics tools, including those provided by our website hosting provider, to understand in aggregate how visitors use the website. If we introduce analytics or advertising tools that use cookies, we will update this policy and ask for your consent where the law requires it.
1.5. Aggregate Data.
We may compile aggregate statistics about the use of our Services and share them with our affiliates, business partners and other third parties for lawful purposes. Aggregate information does not identify you personally.
1.6. Pilot and Data Programs.
If you or your organization take part in a pilot or data program with us, the collection and use of sensor data recorded with our wristbands, including EMG, IMU and PPG signals, is governed by a separate written agreement. That agreement takes precedence over this policy for the data it covers.
2. CHILDREN
Our Services are intended for businesses and research institutions and are not directed to anyone under the age of 18. We do not knowingly collect PII from children. If you have reason to believe that a child has provided us with PII, please contact us at support@kavana.tech and we will endeavor to delete that PII from our databases.
3. INFORMATION SHARING
We do not sell your PII. We may share PII in the following circumstances: (a) with affiliates of Wearable Devices Ltd. and with service providers that help us operate the Services, such as website hosting and email providers, who are bound by confidentiality obligations; (b) if we become involved in a reorganization, merger, consolidation, acquisition, or any form of sale of some or all of our assets; and/or (c) to satisfy applicable law, to prevent fraud or harm, or to enforce applicable agreements, including investigation of potential violations thereof.
4. INFORMATION SECURITY AND RETENTION
We follow generally accepted industry standards to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of PII. However, no method of transmission or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your PII, we cannot guarantee its absolute security. We keep your PII only for as long as reasonably necessary for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.
5. DATA INTEGRITY, ACCESSING AND UPDATING PERSONAL INFORMATION
We process PII only for the purposes for which it was collected and in accordance with this policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the PII needed to provide or improve our Services. We take reasonable steps to ensure that the PII we process is accurate, complete and current, but we depend on you to update or correct your PII whenever necessary. Nothing in this policy is interpreted as an obligation to store information, and we may, at our own discretion, delete or avoid recording and storing any and all information.
Upon receipt of your written request and enough information to permit us to identify your PII, we will, if required by law, disclose to you the PII we hold about you. Upon your request, we will also correct, amend or delete any PII that is inaccurate. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical, or for which access is not otherwise required.
6. RIGHT TO BE FORGOTTEN
You have the right to have your PII deleted in its entirety. However, we may postpone or deny your request if your PII is in current use for the purposes for which it was collected or for other legitimate purposes such as compliance with legal and retention obligations. To request deletion, please contact us at support@kavana.tech.
7. ENFORCEMENT
We regularly review our compliance with this policy. Please direct any questions or concerns regarding this policy or our treatment of PII to support@kavana.tech. When we receive formal written complaints, it is our policy to contact the person who raised them regarding their concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of PII that cannot be resolved between us and an individual.
8. CHANGES TO THIS PRIVACY POLICY
We may update this policy. We will notify you about significant changes in the way we treat PII by sending a notice to the email address you provided to us or by placing a prominent notice on our website: www.kavana.tech. We encourage you to review this policy periodically for the latest information about our privacy practices.

By providing PII to us under this policy, all users, including without limitation users in the United States, Israel and member states of the European Union, understand and consent to this policy and to the collection and processing of their PII abroad. The servers through which your PII is processed may be located outside the country from which you use the Services and outside your country of residence. Some of the uses and disclosures described in this policy may involve transferring your PII to countries with different levels of privacy protection than your own.
